By using theory-test-cancellations-4all.co.uk, you are subject to, and accept, the following terms of use.
1. All software and services are provided by Theory Training Solutions Ltd (the company). They are on an 'as is' and 'as available' basis with no warranties of any kind. This does not affect your statutory rights.
2. By using theory-test-cancellations-4all.co.uk, and providing us with your provisional licence number, you agree to us making changes to your theory test date and time on your behalf. You also grant us permission to log in to the DVSA website using your details.
3. The company has no affiliation with the Driver and Vehicle Standards Agency (DVSA). Therefore, subscription to theory-test-cancellations-4all.co.uk does not guarantee to find you an earlier test date.
4. We will first reserve a theory test that matches your preferences and will then confirm the test booking once you have confirmed by SMS, email or through our app that the date and time is suitable. Reservations which have not been converted to theory test bookings expire after approximately 12 minutes. The reservation period begins when we reserve the test on the DVSA system. We cannot be held responsible for delivery delays in the SMS, app notifications and email networks. Any such delays could mean that your reservation notification arrives after the expiry period of the reservation, however this is very unusual.
5. It is your responsibility to cancel your theory test if you accept a test date and you can no longer take that test. It is also your responsibility to inform us if you wish to change your theory test date again.
6. It is your responsibility to check with the DVSA that any changes made by us have been completed successfully before you make any further arrangements regarding your new theory test. This includes but is not limited to 1) organising and paying for any last-minute theory tuition lessons, 2) organising and paying for any transport to the theory test centre, 3) organising and paying for any accommodation near the theory test centre, and 4) taking time off work/college/school. We will always confirm to you any changes that we have been able to make to your test. The DVSA will also confirm any changes to you if they have your email address. You must wait for confirmation from us and the DVSA before you start to make plans and preparations for your new theory test. We are not liable for any expenses or compensation caused by you incorrectly assuming your theory test has been changed.
7. We cannot be held responsible for the DVSA changing the date and/or time of your test, or for them cancelling your theory test.
8. We cannot be held responsible for failing to change your theory test due to factors beyond our control. This includes, but is not limited to, the DVSA website being unavailable.
9. The learner driver is responsible for turning up to the theory test on time and taking the correct documentation. We cannot be held responsible for any theory tests that are cancelled due to reasons that are the responsibility of the learner driver. This includes but is not limited to the above learner driver responsibilities.
10. We are happy to provide you with a full refund up to 60 days after your purchase, even though we have been searching for you, if we are unable to find you a suitable theory test (i.e. we have not sent you a notification and you or somebody else has not changed your test date). Refund requests will need to be emailed to accounts@theory-test-cancellations-4all.co.uk.
11. Certain paid account types may be upgraded by the user at any time. However, it is not possible to then downgrade those accounts. Any upgrade fees paid are non-refundable unless we are unable to find a test for you.
12. As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you are entitled to cancel your purchase and request a full refund of your payment, within 14 days from purchase, if the service is yet to begin. The service starts as soon as we start searching for theory tests for you, which will normally start soon after payment and entry of your preferences.
13. We will record details of usage of the service including, but not limited to, your personal details provided at the time of taking out the services, search times, dates and times that are found, and emails and SMS messages that are sent to you and received from you.
14. By giving us your details, you agree to us passing your information to the DVSA in order to change your theory test. Theory test alerts will be sent to you by our third-party communication supplier based in the USA if you are using our Apple or Google Android push notification apps. We will not send them your personal information. All details will be held by us in accordance with the Data Protection Act.
15. Our service contains features that allow us to monitor accounts and ensure that we are providing the best possible service for you. An example of this is a temporary limit on the number of text messages we send to you. We may temporarily stop sending you text messages if we have sent you several notifications by text messages and we have not heard back from you. We will contact you to confirm that you have been receiving the text messages, and to discuss how we can update your preferences or improve our service so that we will be sending you notifications of tests that you would like to book. In these circumstances, you will still receive notifications by email (and by push notifications if you are using our mobile device apps). We will continue to send text messages to you after we have discussed your account with you, at no further cost. You should not experience any interruption to the text messages we send to you if you set your account preferences to dates and times that you can take a test.
16. Each account purchased from us can only be used to search for theory
tests on behalf of the owner of the driving licence number that is entered in the
driving licence number box on the account preferences form. We reserve the right
to suspend accounts without refund where we believe the account is not being used
according to this rule. We will make reasonable efforts to contact you before suspending
your account. If you are a driving instructor and wish to use our services, please
contact us to discuss our services that have been specifically designed for use
by driving instructors.
17. By registering your details with the company, you agree to the company sending
you emails and SMS messages to the email address and mobile telephone number you
provide on registration. Your personal details will not be passed on to third parties.
18. All content included on this site, including text, graphics, logos, button icons,
images and software, is the property of the company or its content suppliers and
is protected by international copyright laws. All programs used on this site are
the property of the company or its software suppliers and are protected by international
copyright laws. Any attempt at reverse engineering, disassembly, or de-compilation
of programs, unless it is explicitly permitted, is prohibited by law.
19. The company may send notices to you via SMS, email or regular mail. The company may also provide notices of changes to the terms or other matters by displaying notices or links to notices to you generally on the services provided by the company.
20. The integrity of this system relies on proper use of email and SMS messages as
a message passing media. The use of the email or SMS message system(s), directly
or indirectly as a spamming tool, or other than it is intended, is prohibited.
Commissions
We offer a commission model enabling you to promote our service in return for commission.
You must have either a free trial or paid Theory Test Cancellations 4 All account to earn commissions.
If your free trial account has expired, please contact our support team who will grant you access to your Theory Test Cancellations 4 All account.
Note that you will not receive any further searches if your free trial account is reopened.
You can promote our service using the social sharing plugins accessible in your Theory Test Cancellations 4 All account.
You will also be given access to your own unique links which you can share.
You will earn commission equal to 20% of the sale price for any purchase (including upgrades) when:
- someone referred to the Theory Test Cancellations 4 All website via one of your referral links makes payment to us (the company) for the Theory Test Cancellations 4 All service
- the owner of the referred Theory Test Cancellations 4 All account is no longer entitled to a refund (full refund eligibility criteria set out in clause 10)
We will endeavour to pay any commissions within 30 days of the commission being earned, and they will normally be paid at the beginning of each month.
The commission percentage is subject to change at our discretion. You will be notified of any changes in writing, normally via
email and notices on our website.
You waive your right to be paid those commissions if we cannot get in contact with you using the contact details provided during set up and we cannot pay you commissions because you provided incomplete or incorrect payment information.
Commissions are paid on a last click basis. Should a user access our site via multiple referrer links, the last referrer will
receive the commission on any purchase made.
It is your responsibility to determine what, if any, taxes apply to the payments you make or receive, and it is your responsibility
to collect, report and remit the correct tax to the appropriate tax authority. Theory Test Cancellations 4 All is not responsible for
determining whether taxes apply to your transaction, or for collecting, reporting or remitting any taxes arising from any transaction.
